Advertising Reporting Rule
West Virginia Code 5A-3C-13 mandates the Pharmaceutical Cost Management Council to promulgate a rule requiring manufacturers and labelers to report their advertising costs. On August 24, 2007 the West Virginia Secretary of State approved an emergency advertising reporting rule.
The Council received the first advertising expenditure reports on March 1, 2008 for the period of July 1, 2007 to December 31, 2007. The data analysis from this reporting period is being performed at this time; a narrative and summary report will be available at the conclusion of the data analysis. When available, the summary report will be available for viewing and downloading by a link posted on this page and a notice on the Home Page.
During the 2008 regular Legislative Session the legislative rule was passed with some technical revisions; reporting for calendar year 2008 and all subsequent years are governed by this rule.
